Late last year, the U.S. Citizenship and Immigration Services (USCIS) published a new Form I-9, which incorporated a number of changes as well as the ability to complete the form electronically. Employers had to switch over to the new Form no later than January 22, 2017. Now, the USCIS has announced that there will be another, newer version of Form I-9, to be published no later than July 17, 2017.
The new Form I-9 will incorporate updates requested by the Department of Homeland Security, which are intended to address:
- The International Entrepreneur final rule, effective on July 17, 2017, which covers use of parolee status of entrepreneurs seeking to enter the U.S. to work; and
- An updated List of Acceptable Documents, now inclusive of a State Department form indicating birth abroad.
Employers will be able to use the previous version of Form I-9 (Rev. 11/17/16) until September 17, 2017, at which point they must begin using the new Form I-9. All previous versions will be considered invalid after that date.
