Chicago, Illinois to Require Paid Sick Leave

The Chicago City Council recently amended the Chicago Minimum Wage Ordinance (“Ordinance”) to include paid sick leave (“PSL”), effective July 1, 2017.  Employers who do not already offer sufficient paid time off, or have not already adjusted their business policies and practices to provide paid sick leave to eligible employees, plan for compliance with the Ordinance.  A recap of key provisions of the Ordinance includes the following:

NOTE: San Diego’s paid sick leave ordinance was amended shortly after becoming effective. Be sure to check out our Alert regarding the amended ordinance.

San Diego joins a number of other California cities in implementing its own paid sick leave and minimum wage ordinance.  The ordinance was approved by San Diego voters on June 7, 2016, and goes into effect once the election results are certified (expected to be no later than July 7, 2016).

San Diego’s paid sick leave expands upon the statewide paid sick leave (“PSL”) law in several areas. Key provisions of the PSL ordinance include:

Minneapolis, MN to Require Paid Sick Leave

The Minneapolis Sick and Safe Time Ordinance (“Ordinance”), passed by the City Council on May 27, 2016, requires private employers of at least six employees in any location to begin providing paid sick leave (“PSL”) benefits by July 1, 2017 to any employees working in Minneapolis. Employers of five or fewer are subject to the same provisions, but can offer unpaid time off.

Los Angeles, CA Tentatively Approves Ordinance for Expanded Paid Sick Leave

The Los Angeles City Council voted 13-1 to approve a new ordinance that would expand Los Angeles employees’ paid sick leave rights.  Currently, the California statewide Paid Sick Leave Law requires employers to provide a minimum of 3 paid sick days to all employees.  The new ordinance doubles the statewide minimum, requiring Los Angeles employers to provide at least 6 days of paid sick leave.

New York City, NY: Newly Adopted Rules Amend the Earned Sick Time Act

The New York City Department of Consumer Affairs (DCA), which enforces the Earned Sick Time ACT (ESTA), recently published a notice amending the rules of the City of New York (hereinafter, “Adopted Rules”).  The Adopted Rules provide guidance on how the ESTA, which was effective April 1, 2014, will be enforced.

Vermont Becomes Fifth State to Pass Paid Sick Leave Law

On March 9, 2016, Vermont joined four other states in requiring all private employers statewide to provide paid sick leave benefits to their workers. Beginning in 2017, Vermont employees who work at least 18 hours per week will accrue three days of paid sick leave.  The law includes a phase-in period for small employers (meaning five or fewer employees), who will not be subject to the law until 2018.

Update:  The implementation of Santa Monica’s paid sick leave was later delayed until January 1, 2017. Read more about the delay here.
Beginning July 1, 2016, the City of Santa Monica will increase minimum wage for employers of 26 or more employees to $10.50 an hour.  Wages are set to increase annually through July 1, 2020, ultimately reaching $15.00 an hour.  The ordinance allows employers of less than 26 to be phased in a year later, with the first wage increase to $10.50 effective July 1, 2017.
