North Carolina: Updates to State Government Employment Protections

Effective October 1, 2026, North Carolina’s SB 1041, the Public Workforce Modernization Act, replaces the state’s existing Human Resources Act (Chapter 126) with a new Chapter 126A, representing the first comprehensive update on how the state government hires, pays, and manages its workforce since the 1960s. Key changes include expanding paid parental leave to 12 weeks for both parents, adding statewide bereavement leave, creating new apprenticeship and fellowship pathways, shortening the temp-to-permanent window, increasing compensation flexibility for agencies from 10% to 30%, allowing performance-based pay incentives, requiring grievances to be resolved within 120 days, and expanding employment preference to spouses of active-duty service members. Notably, the law applies only to state government employers and does not directly affect private employers.
