Change to California Posting Requirements as of April 1, 2016

Earlier this month, the Fair Employment and Housing Act (“FEHA”) regulations were revised, changing, in part, the California Pregnancy Disability Leave notice that employers are required to post.  Specifically, the change relates to the language required in the notice itself.   Employers have the option to (1) post the revised notice specified in the regulations, unless it is inconsistent with the employer’s own policy, or (2) post a notice developed by the employer that is consistent with the regulatory requirements.

Employers with five (5) or more employees and public entity employers of any size are required to post the revised California Pregnancy Disability Leave notice, or otherwise comply with the notice changes, beginning on April 1, 2016.  Take care not to change the required notice prior to April 1, 2016.

  • Applicable employers can:
    • After reviewing the instructions below, click here to download the revised FEHA notice in English for posting on the employer’s premises, in conspicuous places where employees are employed; the Spanish version is available for download by clicking here.
      • *INSTRUCTIONS FOR POSTING:
        • If you received your 2016 employment poster from ManagEase, cross out the “Notice A” and “Notice B” sections of the California Pregnancy Disability Leave by putting an “X” over the entirety of those sections, and write over each of those sections, “See DFEH revised notice effective 4/1/16.”
        • Post the page of the new notice over former Notice A and Notice B, so that those sections are covered by the new notice, by affixing only the top of the new notice page, leaving the bottom of the page loose.
        • Be sure not to cross out the federal pregnancy disability leave notice, given that the changes affect the California portion only.
    • Contact concierge@managease.com to order an updated 2016 employment poster, which will contain the revised notice. For orders placed by March 31, 2016, ManagEase will honor a 20% discount on the replacement poster.
